High Court Enforcement
High Court Enforcement Officers (HCEOs) can enforce a debt, based on the following provisions:
- If we have obtained a CCJ;
- The defendant has not made the payments agreed by the court;
- The debt is over £600;
- The debt is not regulated by the Consumer Credit Act;
A CCJ will need to be transferred up to the High Court in order for our HCEOs to enforce the High Court Writ.
When we instruct our High Court Enforcement Officers, they typically have greater powers than a usual County Court Bailiff, including turning up at the defendant’s property outside of standard working hours. This is typically more effective as the defendant is more likely to be at home during the time of the visit. As our HCEOs are a private company, rather than court appointed, they tend to get significantly better results as they are more performance based.
Upon instruction, our HCEOs will obtain a High Court Writ of Control, which is only issued when a Judgment has been obtained and the defendant has either failed to pay the full amount or has fallen behind on at least one instalment payment.
The Writ can be issued for the entire amount owed or a portion thereof. Once issued, our HCEOs will endeavour to recover the outstanding amount under the Writ or seize goods equivalent to or exceeding the Writs value. Within 15 working days of the Writ being issued, the HCEOs will visit the defendant's address to identify goods for potential auction sale or collect a payment to prevent the sale of goods.
If the defendant has multiple addresses, the HCEOs will visit each address sequentially. When determining whether goods are suitable for levy, the HCEOs consider the costs of removal, storage, and sale, including the use of a removal van and necessary manpower; goods are then typically sold through a local auction house. Defendants have the option to apply for a suspension of the Writ, requiring submission of a full financial statement to the court. Subsequently, the claimant may agree to suspend the Writ on the condition of regular instalment payments.

We will aim to get the large majority, if not all of the costs added onto the debt. The Transfer Up Fee is refundable upon the debt being fully collected; on the other hand the abortive fee is only payable upon failure of the case.
