Third Party Debt Order
A Third Party Debt Order is a court order that freezes funds held by an individual, organisation, or institution such as a bank or building society, which might otherwise be paid to the customer against whom the claimant has a Judgment.
The entity or individual holding the funds is referred to as the Third Party. This order prevents the defendant from accessing the funds until the court decides whether the money should be paid to the claimant.
The funds held by the Third Party must belong exclusively to the defendant. For instance, a claimant cannot seek a Third Party Debt Order against a joint bank account unless the Judgment debt is owed by all account holders, such as a husband and wife.
